1. Who we are

These Terms of Service ("Terms") apply to your use of the Smuchie online store (the "Store") and to every purchase you make from it. In these Terms, "Smuchie", "we", "us" and "our" mean the business that runs the Store, and "you" means the person using the Store or placing an order. You can reach us at support@smuchie.com.

2. Using the Store

By using the Store or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy and Shipping Policy, which form part of these Terms. You must be at least 18 years old to place an order. The Store is for consumers buying for their own personal use, and we deliver to addresses in the United States only.

3. Health and safety

Smuchie shorts use electrical muscle stimulation (EMS) to make muscles contract. They are a personal toning product, not a medical device. They are not intended to diagnose, treat, cure or prevent any disease or medical condition, including bladder leaks, incontinence or pelvic organ prolapse, and they do not replace advice or treatment from a doctor or physical therapist.

Do not use Smuchie if you are pregnant, have a pacemaker or other implanted electronic device, have epilepsy, a heart condition or active cancer, have metal implants in the area the pads cover, or have broken, irritated or numb skin where the pads sit. If you have any medical condition, have recently given birth or had surgery, or are unsure whether Smuchie is right for you, ask your doctor before using it.

Always follow the instructions that come with the product: start at the lowest level, place the pads flat against clean skin, and keep to the recommended session length. Stop using it straight away and seek medical advice if you feel pain, burning, dizziness or discomfort, or notice skin irritation. Keep the product away from children.

4. Results

Smuchie is designed to help tone and strengthen the muscles it works, such as your glutes, thighs and pelvic floor. It helps; it is not a guarantee. Results vary from person to person and depend on things like how often and how long you use it, your body, age, health, activity and diet. We do not promise or guarantee any particular result, or any result within any particular time.

• Smuchie is not a weight-loss product. It does not burn fat, remove cellulite, reduce inches or build muscle size, and it is not a replacement for exercise.
• Figures such as the number of contractions in a session describe what the device delivers, not a result in your body.
• Reviews, testimonials, before-and-after photos and statistics on the Store show individual experiences or survey answers. They are not typical or guaranteed results, and your experience may be different.
• Photos and videos on the Store may show models and are for illustration.

Because results vary, we don't offer refunds based on results. Unopened, unworn items can be returned within 30 days of delivery under our Refund Policy.

5. Products

We describe and show our products as accurately as we can, but colors on screen, packaging and small design details may vary. Please use our size guide before ordering.

6. Orders

Your order is an offer to buy. A contract between you and us is formed when we email you an order confirmation. We may decline or cancel an order, for example where an item is unavailable, where there is an obvious error in a price or description, or where we suspect fraud. If we cancel an order you have paid for, we refund you in full.

Every order is processed the moment it is placed, so you can't cancel or change an order once it has been placed. Please check your size, model, bundle and address before you pay. Unopened, unworn items can still be returned within 30 days of delivery under our Refund Policy.

7. Prices, payment and offers

Prices are in US dollars and are the prices shown when you place your order. Payment is taken at checkout using the methods shown there. Any applicable sales tax is shown at checkout.

Sales, bundle offers, free gifts and discount codes are available for a limited time and may change or end at any time. Offers can't be combined unless we say so. Free pairs and free gifts are part of the offer you buy, have no cash value and can't be exchanged for cash. Sale countdowns show the timing of an offer on the Store and may differ between visitors.

8. Shipping

Delivery times, tracking and what happens if a parcel is late, lost or damaged are set out in our Shipping Policy.

9. Refunds and replacements

Returns of unopened items, free replacements for damaged or faulty items, and the rules on returns are set out in our Refund Policy.

10. Reviews and content you send us

If you send us a review, photo, video or message about our products, you confirm it is honest, your own, and doesn't break anyone's rights, and you allow us to use it to run and promote the Store. We will ask for your permission before we show your photo or video.

11. Our content

All content on the Store, including text, images, videos, logos and designs, belongs to us or our licensors and may not be copied or used without our written permission.

12. Warranties and liability

Except as stated in these Terms and our policies, and to the extent the law allows, the Store and our products are provided "as is", without any other promises or warranties, including any promise of a particular result.

You use the product at your own risk and are responsible for using it as instructed and for following the health and safety guidance in section 3. To the extent the law allows, we are not liable for injury, loss or damage caused by misuse, by using the product against its instructions or warnings, or by any health condition you have; we are not liable for any indirect or consequential loss; and our total liability for any order is limited to the amount you paid for it.

Nothing in these Terms limits any rights you have under consumer protection law that can't be limited, or our liability where it can't be limited by law.

13. Your responsibility

You agree to use the Store and our products lawfully and as instructed, and to compensate us for any claims, losses or costs that arise from your misuse of the product or from breaking these Terms, to the extent the law allows.

14. Problems and disputes

If something goes wrong, please email support@smuchie.com first so we can put it right; most problems are solved within a few days. These Terms don't take away any protection you have under the mandatory consumer laws of the state where you live.

15. Changes to these Terms

We may update these Terms from time to time. The version in effect when you place your order applies to that order.
